Update to Illinois Employment Law: AI Background Checks & Your Rights

Is an Algorithm Denying You a Job? New 2026 Illinois Laws Target AI Bias in Background Checks


In 2024, the Employee Background Fairness Act changed the game by forcing employers to perform "individualized assessments" before denying someone a job due to a criminal record. But in 2026, a new player has entered the courtroom: Artificial Intelligence. Many Chicagoland employers now use AI "screening bots" to scan resumes and run background checks. If that bot automatically rejects you because of a 5-year-old conviction or even your zip code, it may be violating the 2026 Illinois Human Rights Act Amendments.



The New AI Transparency Rule (HB 3773)


As of January 1, 2026, Illinois employers are legally required to notify you if they use AI to:

  • Screen your application.

  • Conduct an automated background check.

  • Predict your "risk" as an employee.

If you weren't notified that an algorithm was judging your record, any adverse action taken against you could be the basis for a civil rights claim.



Zip Codes as a "Proxy" for Race


The 2026 law specifically bans employers from using AI that relies on zip codes as a proxy for protected classes. This is a common tactic in automated screening that disproportionately affects residents in specific South Side and West Side neighborhoods. If an AI tool "filtered" you out based on where you live or your proximity to a past offense, that is now a direct violation of Illinois law.



The "Human-in-the-Loop" Requirement


The 2024 Background Fairness Act required a human to look at "rehabilitation efforts." In 2026, the law clarifies that an employer cannot hide behind the excuse of "The software did it." Even if a third-party background check company uses AI to "flag" you, the Illinois employer owns that decision. They must still prove that your past has a "substantial relationship" to the job, and they must provide you with a copy of the specific report the AI used to flag you.



Your 2026 "Right to Contest"


If you are denied a job due to an automated background check, you have a 5-day window to:

  1. Demand the "Reasoning": Ask for the specific factors the AI used to disqualify you.

  2. Provide Mitigation: Show evidence of your expungement efforts or certificates of rehabilitation.

  3. File a Charge: In 2026, the window to file a charge with the Illinois Department of Human Rights has been extended to 2 years (up from the old 300-day limit).
